Mediation is a cost effective approach and great option for transitioning families so long as there is still a level of trust and communication between the parties. Generally, a mediator assists the parties in reaching a settlement agreement by facilitating communication but a mediator cannot give legal advice even if he or she is a licensed attorney.
A licensed family law attorney can assist a person going through mediation by giving counsel on the legal issues. An attorney does not need to be engaged for all aspects of the mediation process but can be retained on a limited scope basis to give legal counsel, attend settlement meetings or review a proposed Judgment. This engagement ensures the rights of the party are explained and give the party confidence that the agreement is entered into intelligently and knowingly.
